ORDER

 

Counsel for respondent submits that signals are being supplied to the petitioner even though the petitioner is not paying as per the figure of subscribers suggested by the petitioner itself.  Counsel for the petitioner disputes this.  However, we direct that the petitioner will continue to pay to the respondent at least on the basis of the figure of 880 connections which is the number of subscribers according to the petitioner.  Parties will also reconcile the accounts in the meanwhile. 

 

Parties’ counsel agree for a joint survey to determine the subscriber base.  Let the joint survey commence on 30.4.2007 at 11:00 a.m.   Parties will meet in the office of the petitioner for this purpose on that date.  We direct both the parties to cooperate in conducting the joint survey.  Videography is permitted to either party, if so desired.
