  ORDER

 

            Notice.  Mr.Kaushik Mishra, Advocate accepts notice on behalf of respondent. 

            Learned counsel for petitioner has invited our attention to the public notice dated 12th September, 2008 and the grounds for threatened action stated therein.  With reference to the documents filed by the petitioner it has been shown that none of the grounds alleged in the notice exist.  Prima facie, we are satisfied with the submission  made by the counsel for petitioner.  Accordingly, respondent is restrained from acting in pursuance of public notice dated 12th September, 2008 till further orders.

            Counsel for respondent submits that three cheques of Rs.5.00 lakhs each issued by the petitioner have bounced.  Counsel for petitioner in reply submits that if the respondent is able to show him the particulars about this, he will ensure that the payments of the three cheques is made within two days.

            Reply be filed within two weeks.  Rejoinder, if any, be filed within two weeks thereafter. 

            List on 10.12.2008 for hearing.
